Disability Standards 2010 Legislation Important Compliance Date Approaches

The Disability (Access to Premises - Buildings) Standards 2010 legislation came into force on the 1st of May 2011.

The objects of these Standards are:

(a) to ensure that dignified, equitable, cost-effective and reasonably achievable access to buildings, and facilities and services within buildings, is provided for people with a disability; and

(b) to give certainty to building certifiers, building developers and building managers that, if access to buildings is provided in accordance with these Standards, the provision of that access, to the extent covered by these Standards, will not be unlawful under the Act.

The Scope in Section 2.1 is defining the classes of buildings the standard will apply and in 2.2 defines the persons to whom the standard applies. While a building certifier or a developer is very likely to be fully aware of the standards due to new constructions or modification which required approvals, some persons who are classified as building managers may not be fully aware of the full impact of the legislation.

Latter is important to note as the legislation specifially has compliance levels to existing buildings which have to be achieved - unless exemtion is granted - to nominated target dates as follows;

Item 3 and 4 level of compliance date is the 31st of December 2012, which is approcahing very fast. While only the surfaces, handrails and grabrails will have a 100 percent level of compliance requirement specified, various other items also have a 55 percent level of compliance requirement to be achieved.
