CONDITIONS OF ENTRY
1. Information on how to enter and prizes form part of these Conditions of Entry.
2. Entry is only open to all Australian residents. Employees and their immediate families of the Promoter, participating outlets and their agencies associated with this promotion are ineligible.
3. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
4. To enter, purchase a 80L Toby Unithane (gloss, semigloss, satin or matt), 80L Toby Lustapol, 80L Toby Tung Oil, 40L Toby Aquamax Commercial, or 40L Toby Aquamax Domestic, from a participating store, fully complete the official entry form and place it in the Red TOBY entry can in-outlet, during the promotional period.
5. Entrants must retain sales receipt(s) for all entries as proof of purchase.
6. Multiple entries accepted but each entry requires a separate product to be purchased. Limit one entry permitted per product
7. No responsibility accepted for late, lost or misdirected entries.
8. Promotion commences 9/5/05.  Entries into Minor Draw close end of business on 12/6/05. Entries into the Major Draw close end of business on 31/7/05.   Only valid entries received prior to the closing time/date for the Minor Draw will be entered into the Minor Draw. All valid entries received prior to the closing time/date for the Major Draw, including winners from the Minor Draw, will be entered into the Major Draw.
9. Both draws will take place at 1330 Ferntree Gully Road, Scoresby VIC 3179 at 11.00 AEST on 24/6/05 (Minor Draw) and 15/8/05 (Major Draw). Winners will be notified by mail and their names will be published in The Australian on 1/7/05 (Minor Draw) and 25/8/05 (Major Draw).  Judges' decision is final and no correspondence will be entered into.
10. Minor Prize Draw: The first two (2) valid entries drawn will each win a Canon Digital Camera valued at $461.
11. Major Prize Draw: The first valid entry drawn will win a Home Entertainment Package valued at $6,840 consisting of a Panasonic HD Plasma television, a Panasonic DVD Recorder Pack, and a HD Digital Set Top Box.  The next three (3) valid entries drawn will each receive a Canon Digital Camera valued at $461.
12. Total prize value is $9,145.  The Promoter accepts no responsibility for any variation in the prize value.  Prizes are not transferable or exchangeable and cannot be taken as cash.
13. If the winner of a Major Prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
14. The Promoter may conduct such further draws at the same place as the original draw as are necessary on 1/2/06 in order to distribute any prizes unclaimed by that date, subject however to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). In the event of any winners of prizes their names will be published in The Australian on 6/2/06.
15. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law.
16. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
17. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
18. The Promoter reserves the right to request winners to provide proof identity and residency at the nominated prize delivery address.  Identification considered suitable for verification is at the discretion of the Promoter.
19. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.
