Purpose
Examine AS 4000:1997 in light of its intended use in construction projects. Cover key elements such as the drafting principles behind the Standard, completion of the Annexures, the role of the Superintendent, time, programming and liquidated damages, variations and other claims, payment including security of payments, defect rectification, breach of contract and dispute resolution.
Course Outline
This workshop will comprise a case study covering a typical project from inception, i.e. the calling of tenders through to the following stages:
- Formation of the contract itself
- The role of the Superintendent in relation to the administration of that contract
- Documentation relating to the project and the obligation of each party to provide information to the other
- Latent condition claims
- Claims for extensions of time and the procedures to be followed by the parties and the Superintendent in relation to extensions of time under AS 4000
- Variations
- The payment regime of AS 4000
- Default by the Contract in relation to effecting work in compliance
- Default and insolvency - examination of the procedures under Clause 39
- Dispute resolution procedures; and
- Examination of the current status of Security of Payment legislation in each of the relevant States of Australia and how the impact affects the Payment of Workers and
- Subcontractors, payment of payment claims and its relation to AS 4000
- The drafting principles behind the standard
- Completion of the Annexures
- Time, programming and liquidated damages
- Breach of Contract and dispute resolution
- An outline of the changes made to AS 4000 compared with its predecessor AS 2124:1992.

- Explanation of the structure and operation of AS 4000
- Comparison of the differences between AS 4000:1997 and AS2124:1992

Some knowledge of construction project administration is desirable.

John has conducted well over 200 public and "in-house" workshops on Conditions of Contract firstly for various State Governments when they adopted AS 2124:1992 and since 1994 for Standards Australia / SAI Global on AS 2124:1992, AS 4300:1995, AS 4000:1997, AS 4910:2002 and AS 4911:2003.
John is a construction lawyer who played a major role in the Committee OB/3 of Standards Australia which drafted AS 2124-1992 and AS 4000-1997 and their respective suites of contracts.
He is the author of the Standards Australia Handbooks SAA HB 42-1993 and HB 57 for use with AS 2124-1992 and HB 54 for use with AS 2545-1993. He is also the author of the NPWC Guidelines and Documentation Manual for AS 2124-1992.
He is also the author of the acclaimed Administration Manual HB 140-2000 for AS 4000-1997.
John has his own legal and consultancy practice in Melbourne and Western Australia specialising in commercial construction law.
He is one of Australia's foremost trainers in construction contract administration and for over 20 years has been a part time lecturer in Project Management at Victoria University, for which he has recently been honoured with the award of Honorary Adjunct Associate Professor by that University.
He is also on the Advisory Board for the Construction Law Program, Faculty of Law, University of Melbourne.
